Given this sham of a case is exposed more with each passing day, DA Mike Nifong is so desperate to make a case where there is none, that he’s hunting for information on players who were never accused of rape by the stripper accuser.

The lawyers, Thomas Manning of Raleigh and Bob Ekstrand of Durham, representing lacrosse player Frederick Krom Jr., and Bill Thomas of Durham, representing Bruce Edward Thompson, asked a judge to quash two subpoenas issued by Nifong May 31.
In the subpoenas, Nifong demanded that Duke give him the home addresses of 47 lacrosse players and two other students, and also identity-card data that could track their whereabouts around the time of the alleged rape.

Neither Krom nor Thompson is among three lacrosse players indicted for allegedly raping an exotic dancer in mid-March during an off-campus party at 610 North Buchanan Blvd. The indicted suspects are Reade Seligmann, Collin Finnerty and David Evans.
In paperwork filed Thursday, lawyer Thomas said he wanted Nifong’s subpoenas quashed to safeguard his client “from individuals and groups who had freely and publicly threatened members of the Duke lacrosse team.” He also said the Durham District Attorney’s Office “has a past history of abusing its authority to issue subpoenas.”

According to Thomas, the May 31 subpoenas were “facially invalid” because they violated the Family Educational Rights and Privacy Act (FERPA), a federal law.
In addition, Thomas said the subpoenas “were issued erroneously as they are not supported by an affidavit providing legal justification for piercing the shield of confidentiality provided by FERPA, but rather are unilateral commands by a prosecutor — not a detached, independent judicial officer.”

With the indictments already in, Nifong is trying to gather personal information on people who were not accused. Does he just want to contact them with some questions, now that they are on summer break? I say probably not. And no matter where they were, they have not been accused of rape by the stripper accuser. So does Nifong think that maybe they lied about where they were? It’s not like their location any time that night is going to change any of the facts in this case. Because the fact is that there is no case. The foundation of his case is the accuser and she has no credibility. So going after these other guys is nothing but a desperate act by a desperate man.
