Oh happy day! The US Supreme Court is going to have to once again face the issue it typically wants to run from. Ever since Roe v. Wade, baby killing in America has cost this nation over 47,282,293 lives.
So why fight this fight? Because we know a pregnant woman is holding a human life. Every human being on earth was born from a womb. So there is no question that conception creates a human life. Our Constitution protects life, liberty and property. To think of a human life as property is a violation of the 13th Amendment of the Constitution.

So parents cannot look at their children as “property”, even in the womb. They are a life. Now granted, the 14th Amendment does mention:

So all people BORN AND SUBJECT TO THE JURISDICTION OF THE USA are considered citizens who are subject to our laws. (For more on this, see the post about Anchor Babies.) But the debate regarding abortion is not one of whether or not the LIFE is a citizen, but that it is a LIFE. Under our laws WE ARE NOT ALLOWED TO KILL ANYONE, no matter if they are a US citizen or not. So it does not matter that a life is not a US citizen. What matters is that we know a pregnant woman is holding a life within her womb.
Now that we know we are dealing with a human life, we must treat that life as we would any other person and we cannot deprive anyone of life. According to the 5th Amendment.

So no baby in a mother’s womb can be deprived of life, without due process. Aborted babies have no trial and are never found guilty of any crime.
Given babies in the womb:
They must be protected and it is the states’ duty to protect lives. Therefore South Dakota’s abortion ban is fully Constitutional. In fact, the federal government has the Constitutional duty to protect life if states will not. So the current Roe v. Wade situation turns our Constitution on its head. Roe v. Wade must be overturned, given the ruling is unconstitutional.
La Shawn Barber has more about the situation in SD and asked for a pro life defense. I think my argument is Constitutionally sound and will be proven to be in the future.
