Democratic Senator says he wants judges to make laws for him

The Senate hearings for Judge Samuel Alito’s nomination to the US Supreme Court are pretty boring. And they are that way because Democrats have nothing on Judge Alito. So the Senators are just sitting around making what amount to nothing but personal campaign speeches regarding issues that rattle their base. They are saying a lot, while not allowing Judge Alito to say much. It seems their “questions” are taking about twice as long as Judge Alito’s answers and most of their question are usually just a bunch of rhetoric. Democrats are frustrated that they can’t pin anything bad on Alito and Alito is so smart he’s making Democrats look like total idiots.

In one exchange the lunacy of the Democrats really rang like a bell! Wisconsin Democratic Senator Herbert Kohl actually admitted that he would like for judges to create laws from thin air. To me this is an admission from him that he is upset, that he can’t have his way with the legislative branch of government. That he and his fellow Liberals are unable to defy the will of the people with their radical proposals. So they look to the judicial branch to make up laws, like the Federal government forcing states to allow people to kill their own babies in the womb.

Herbert Kohl from Wisconsin insisted there are times when judges should legislate from the bench.

?The neutral approach, that of the judge just applying the law is very often inadequate to ensure social progress, right historic wrongs and protect civil liberties so essential to our democracy. So isn’t it true, Judge Alito, that a neutral judge would never have reached these conclusions? In fact, for decades, courts did not reach these conclusions??

Alito says he doesn?t share that view of the bench.

?The principles don’t change. The Constitution itself doesn’t change. But the factual situations change. And, as new situations come up, the principles and the rights have to be applied to them.?

Maybe Robert Byrd should pass Senator Kohl one of his copies of the US Constitution. Because even the former Klansman from West Virginia knows that judges should not make up laws from the bench! It is the legislative branch that makes the laws. Which is why Robert Byrd used the filibuster against the Civil Rights Act of 1964. Because he did not want to see the legislative branch of government have a fair vote on the creation of a law to ensure the Constitutional rights of all citizens. It would really be something if Democrats used the filibuster against Judge Alito.
